Justice Archibald had been appointed to the Supreme Court of Nova Scotia in 1937, and was appointed to the Exchequer Court of Canada on the same day that he was appointed to the Board of Transport Commissioners.

The Exchequer Court found that the defendant was not the proprietor of the mark and not an innocent user, that the registration of the trade-mark had been improperly made and, therefore, should be expunged.
