При чем тут «не сделав»? Он на словах согласился на что-то, что попытался не внести в контракт.

Uly, why is there no past perfect there? Had there been "had agreed", it would be much easier to figure out that he had agreed before he tried to do something else. Isn't it the underlying meaning of the past perfect? (I'm not trying to argue, I'm just wondering.)

Youre right, and, in fact, you could conceivably say HAD AGREED TO in this sentence, but you don’t have to.
