Это вы авторов закона спросите или переводчиков с шумерского.
Да, по сути это "глаз за глаз", “an eye for an eye", но с should непонятно.
Вообще-то у should есть и значение "если", но не в такой конструкции, тем более с if.

Exactly, Grumbler, SHOULD in a hypothetical if-statement serves to reinforce the randomness of the proposed scenario. I’ve often wondered if the уж in если уж serves the same function.
